Brazil: Vice President of Facebook freed from jail

Vice President of Facebook freed from jail

The Vice President of Facebook (Latin America) was arrested but after spending one night in jail, the decision was overturned by a higher court.

 The charges related to a criminal investigation into drug trafficking, and the investigators requested access to Facebook’s Messenger program, and WhatsApp in order to assist their investigation, believing the suspects had used these programmes in their communications with each other.  Daily fines had been in place for at least 2 months, and had increased from 50,000 reals, or $12,600, a day to 1,000,000 reals, or $253,000.  Finally the courts ordered the arrest of Diego Dzodan, Vice President of Facebook.

He was released the following day, and the higher court judge noted that because he was not being investigated, Dzodan could not be legally arrested.  Dzodan was elated and posted thanks to all his supporters on his Facebook page.

Facebook also released a statement, noting their satisfaction with the decision of the court.

Facebook purchased WhatsApp several years ago.  WhatsApp doesn’t retain information and has a special encryption process making it more difficult to give authorities access to data.
